The submission of an application using the teleservice mentioned in article R. 431-2 will result in the immediate issue of a dematerialised online submission certificate. This document does not provide proof of the holder’s legal residence status.
When the examination of a complete application submitted within the time limits mentioned in article R. 431-5 continues beyond the validity date of the residence document held, the Prefect is required to provide the applicant, via the teleservice mentioned in the first paragraph, with a certificate extending the examination of the application, the validity of which may not exceed three months. This document, together with the expired residence document, enables applicants to prove that their residence is legal for the period specified. If, due to special circumstances, the investigation extends beyond the expiry date of the certificate, it is renewed for as long as the Prefect has not ruled on the application.
When the foreign national mentioned in 2°, 3° or 4° of article R. 431-5 has submitted a complete application within the time limit to which he is subject, the Prefect is required to provide him, via the teleservice mentioned in the first paragraph, with a certificate extending the examination of his application, the validity of which may not exceed three months. This document enables applicants to prove that their residence is legal for the period specified. If, due to special circumstances, the examination of the application is extended beyond the expiry date of the certificate, it is renewed for as long as the Prefect has not made a decision on the application.
When the Prefect makes a favourable decision on the application submitted, a dematerialised attestation is made available to the applicant via the teleservice mentioned in the first paragraph, which enables the applicant to provide proof of the legality of their residence, while awaiting the issue of the permit.
