Article R4313-29 of the French Labour Code

In the case of machinery, the notified body shall carry out the examinations and tests enabling it to ensure that:

1° the technical file contains all the necessary elements;

2° the machinery has been manufactured in accordance with the information contained in the technical file;

3° the machinery can be used safely under the intended conditions of use;

4° in the case of a safety component referred to in 3° of Article R. 4311-4, that this component is suitable for performing the intended safety functions;

5° If the technical file refers to standards mentioned in Article L. 4311-7, these standards have been correctly used;

6° The machine complies with the technical rules applicable to it.

Lorsqu’il s’agit d’une machine, l’organisme notifié procède aux examens et essais lui permettant de s’assurer que :


1° Le dossier technique comporte tous les éléments nécessaires ;


2° La machine a été fabriquée conformément aux indications contenues dans le dossier technique ;


3° La machine peut être utilisée en sécurité dans les conditions prévues d’utilisation ;


4° S’il s’agit d’un composant de sécurité mentionné au 3° de l’article R. 4311-4, que ce composant est apte à remplir les fonctions de sécurité prévues ;


5° Si le dossier technique fait référence à des normes mentionnées à l’article L. 4311-7, ces normes ont été correctement utilisées ;


6° La machine est conforme aux règles techniques qui lui sont applicables.
