Article R4313-36 of the French Labour Code

If the decision of a notified body does not appear to be justified, the Minister responsible for labour, on receipt of a complaint, may amend this decision after obtaining the opinion of the Conseil d’orientation des conditions de travail, after the complainant, the applicant for the EC type-examination certificate if different from the complainant and the notified body in question have been invited to present their observations. It takes its decision within two months.

If a complaint remains unanswered for more than two months, it is deemed to have been rejected.

Si la décision d’un organisme notifié n’apparaît pas justifiée, le ministre chargé du travail, saisi d’une réclamation, peut réformer cette décision après avis du Conseil d’orientation des conditions de travail, après que le réclamant, le demandeur de l’attestation d’examen CE de type s’il est différent du réclamant et l’organisme notifié en cause, ont été invités à présenter leurs observations. Il prend sa décision dans un délai de deux mois.

Le silence gardé pendant plus de deux mois sur une réclamation vaut décision de rejet.
