Article R4313-38 of the French Labour Code

Any modification made by the manufacturer or importer to machinery or personal protective equipment in respect of which an EC type-examination certificate has been issued shall be notified to the body which issued the certificate.

The body takes note of these modifications and ensures that they do not require a new conformity examination. In this case, it informs the manufacturer or importer that the EC type-examination certificate remains valid for the model thus modified.

Otherwise, the body shall inform the manufacturer or importer that the EC type-examination certificate is no longer valid. If the manufacturer or importer intends to maintain these modifications, he shall submit a new application for EC type-examination under the conditions and in accordance with the procedures laid down in this sub-section.

Toute modification d’une machine ou d’un équipement de protection individuelle, ayant fait l’objet d’une attestation d’examen CE de type, réalisée par le fabricant ou l’importateur, est portée à la connaissance de l’organisme ayant délivré l’attestation.

L’organisme prend connaissance de ces modifications et s’assure que celles-ci n’exigent pas un nouvel examen de conformité. Dans ce cas, il fait savoir au fabricant ou à l’importateur que l’attestation d’examen CE de type reste valable pour le modèle ainsi modifié.

Dans le cas contraire, l’organisme fait savoir au fabricant ou à l’importateur que l’attestation d’examen CE de type cesse d’être valable. Si le fabricant ou l’importateur entend maintenir ces modifications, il dépose une nouvelle demande d’examen CE de type dans les conditions et selon les modalités prévues par la présente sous-section.
