Article R4382-9 of the French Public Health Code

The establishments listed in article 2 of law no. 86-33 of 9 January 1986 on statutory provisions relating to the hospital civil service, other public sector employers and private sector employers finance continuing professional development initiatives.

They shall implement continuing professional development for the medical auxiliaries, nursing auxiliaries and childcare auxiliaries they employ and may have recourse, for this purpose, to an approved joint collecting body as well as to the approved body mentioned in article 16 of order no. 2005-406 of 2 May 2005 simplifying the legal regime for health establishments, in compliance with the rules for the organisation and funding of lifelong training which are specific to them.

Les établissements énumérés à l’article 2 de la loi n° 86-33 du 9 janvier 1986 portant dispositions statutaires relatives à la fonction publique hospitalière, les autres employeurs publics et les employeurs du secteur privé financent les actions de développement professionnel continu.


Ils mettent en œuvre le développement professionnel continu des auxiliaires médicaux, des aides-soignants et des auxiliaires de puériculture qu’ils emploient et peuvent avoir recours, à cette fin, à un organisme paritaire collecteur agréé ainsi qu’à l’organisme agréé mentionné à l’article 16 de l’ordonnance n° 2005-406 du 2 mai 2005 simplifiant le régime juridique des établissements de santé, dans le respect des règles d’organisation et de prise en charge de la formation tout au long de la vie qui leur sont propres.
