Article R4412-2 of the French Labour Code

For the purposes of this Chapter:

1° Activity involving chemical agents means any work in which chemical agents are used or intended to be used in any process, including production, handling, storage, transport, disposal and treatment, or in the course of which such agents are produced;

2° Chemical agent means any chemical element or compound, either in its natural state or in a mixture, as it occurs in nature or as it is produced, used or released, in particular in the form of waste, as a result of a professional activity, whether or not it is intentionally produced and whether or not it is placed on the market.

Pour l’application du présent chapitre, on entend par :


1° Activité impliquant des agents chimiques, tout travail dans lequel des agents chimiques sont utilisés ou destinés à être utilisés dans tout processus, y compris la production, la manutention, le stockage, le transport, l’élimination et le traitement, ou au cours duquel de tels agents sont produits ;


2° Agent chimique, tout élément ou composé chimique, soit en l’état, soit au sein d’un mélange, tel qu’il se présente à l’état naturel ou tel qu’il est produit, utilisé ou libéré, notamment sous forme de déchet, du fait d’une activité professionnelle, qu’il soit ou non produit intentionnellement et qu’il soit ou non mis sur le marché.
