Article R4421-9 of the French General Code of Local Authorities

The loss of the capacity by virtue of which a member was elected or appointed entails the vacancy of the corresponding seat.

Vacancies occurring more than ten months before the date of the next renewal shall be filled. New members shall serve on the Board until the date on which the term of office of those they replace would normally have expired.

La perte de la qualité en raison de laquelle un membre a été élu ou désigné entraîne la vacance du siège correspondant.

Il est pourvu aux vacances survenues plus de dix mois avant la date du plus proche renouvellement. Les nouveaux membres siègent au conseil jusqu’à la date à laquelle aurait normalement cessé le mandat de ceux qu’ils remplacent.
