Article R444-33 of the French Commercial code

Before any aid is granted:

1° The company referred to in Article R. 444-36 informs the applicant that the aid is subject to the provisions of Regulation (EU) No 360/2012 of 25 April 2012 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid granted to undertakings providing services of general economic interest ;

2° The applicant draws up, in accordance with a model specified by joint order of the Minister for Justice and the Minister for the Budget, a certificate that it sends to the aforementioned company, specifying the total amount of de minimis aid it has received over the last three tax years, including the current one.

Préalablement à l’octroi de toute aide :


1° La société mentionnée à l’article R. 444-36 informe le demandeur que l’aide est soumise aux dispositions du règlement (UE) n° 360/2012 du 25 avril 2012 relatif à l’application des articles 107 et 108 du traité sur le fonctionnement de l’Union européenne aux aides de minimis accordées à des entreprises fournissant des services d’intérêt économique général ;


2° Le demandeur établit, selon un modèle précisé par arrêté conjoint du ministre de la justice et du ministre chargé du budget, une attestation qu’il transmet à la société susmentionnée, précisant le montant total des aides de minimis qu’il a perçues au cours des trois derniers exercices fiscaux, dont celui en cours.
