Article R444-36 of the French Commercial code

The legal entity mentioned in the fourth paragraph of Article L. 444-2 responsible for managing the interprofessional fund for access to law and justice is a public limited company whose capital is held by the State. Its corporate name is: “Société de gestion du fonds interprofessionnel de l’accès au droit et à la justice” (SGFIADJ).

<1° Setting the amount of subsidies;

2° Examining the admissibility of applications for aid submitted to it, and paying the aid to their beneficiaries;

3° Managing the cash position and monitoring the financial equilibrium of the interprofessional fund for access to law and justice;

4° Keeping the accounts of the interprofessional fund for access to the law and to justice and reporting annually on its management to the ministers of justice and the economy;

5° Taking any legal action with a view to the restitution of aid unduly received.

Article R444-36

La personne morale mentionnée au quatrième alinéa de l’article L. 444-2 chargée de la gestion du fonds interprofessionnel de l’accès au droit et à la justice est une société anonyme dont le capital est détenu par l’Etat. Sa dénomination sociale est : “ Société de gestion du fonds interprofessionnel de l’accès au droit et à la justice ” (SGFIADJ).

Cette société assure la gestion administrative, comptable et financière du fonds interprofessionnel de l’accès au droit et à la justice. A ce titre, elle est notamment chargée :

1° De fixer le montant des subventions ;

2° D’étudier la recevabilité des demandes d’aides qui lui sont adressées, et de verser les aides à leurs bénéficiaires ;

3° De gérer la trésorerie et d’assurer la surveillance de l’équilibre financier du fonds interprofessionnel de l’accès au droit et à la justice ;

4° De tenir la comptabilité du fonds interprofessionnel de l’accès au droit et à la justice et de rendre compte de sa gestion annuellement aux ministres de la justice et de l’économie ;

5° D’exercer toute action en justice en vue de la restitution des aides indûment perçues.
