I.-Articles R. 4234-7 to R. 4234-17 are applicable in New Caledonia and French Polynesia in the version resulting from Decree no. 2022-381 of 16 March 2022, subject to the adaptations provided for in II.
II.-For their application in New Caledonia and French Polynesia:
1° In article R. 4234-7:
a) The first paragraph is not applicable;
b) The second paragraph is replaced by the following provisions:
“An order of the ministers responsible for the budget and health sets the amount of compensation allocated to the presidents of the disciplinary chamber of the pharmacists’ association of New Caledonia or French Polynesia. “
2° The second paragraph of article R. 4234-8 does not apply;
3° Article R. 4234-14 reads as follows:
“Art. R. 4234-14 -The parties are informed that they may be represented or assisted by a lawyer.
“However, pharmacists, whether they are plaintiffs, claimants or the subject of the proceedings, may be assisted either by a lawyer or by a pharmacist registered on the roll of the Association, or by both. The pharmacist may not be a member of a council or body of the Order of Pharmacists of New Caledonia or French Polynesia.
“The accused pharmacist is obliged to appear if his appearance is requested either by the President of the Government of New Caledonia or French Polynesia by a writ served by a bailiff or at the request of the Public Prosecutor.
“The President of the Association of Pharmacists in New Caledonia or French Polynesia may be represented or assisted by a full or alternate member of the Association.
“The parties who have chosen to be represented or assisted shall inform the court registry in writing.
“When a party is represented by a lawyer, the procedural acts, with the exception of the summons to the hearing and the notification of the decision, are carried out only with regard to the lawyer. “
