Article R4462-35 of the French Labour Code

The safety file provided for in article R. 4462-34 is kept by the employer at the disposal of the regional director of companies, competition, consumption, labour and employment or the authority which replaces him in application of articles R. 8111-8 and R. 4462-29, agents responsible for monitoring labour legislation, prevention engineers, the occupational health service, the prevention services of social security bodies and social and economic committees.

Persons who have access to the safety file by virtue of the provisions of the previous paragraph are bound, with regard to the information concerning pyrotechnic sites which appears in the file, by the obligations of secrecy and the requirements of confidentiality, under the conditions laid down by the texts which apply to them.

Le dossier de sécurité prévu à l’article R. 4462-34 est tenu par l’employeur à la disposition du directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi ou de l’autorité qui lui est substituée en application des articles R. 8111-8 et R. 4462-29, des agents en charge du contrôle de la législation du travail, des ingénieurs de prévention, du service de santé au travail, des services de prévention des organismes de sécurité sociale, des comités sociaux et économiques.

Les personnes qui accèdent au dossier de sécurité en vertu des dispositions de l’alinéa précédent sont astreintes, en ce qui concerne les informations concernant les sites pyrotechniques qui figurent dans le dossier, aux obligations de secret et aux exigences de confidentialité, dans les conditions prévues par les textes qui leur sont applicables.
