Article R4523-5 of the French Labour Code

In order to extend the composition of the user undertaking’s health, safety and working conditions committee to include representation from external undertakings, in application of article L. 4523-11, it is the responsibility of:

1° The head of the user undertaking’s establishment to identify the external undertakings which meet the criteria defined in article R. 4523-6 and to select from among these the undertakings which are to appoint one or more representatives;

2° The head of each external undertaking to appoint the representatives of his undertaking by name.

Article R4523-5

Pour élargir la composition de la commission santé, sécurité et conditions de travail de l’entreprise utilisatrice à une représentation des entreprises extérieures, en application de l’article L. 4523-11, il incombe :

1° Au chef d’établissement de l’entreprise utilisatrice d’identifier les entreprises extérieures répondant aux critères définis à l’article R. 4523-6 et de sélectionner parmi celles-ci les entreprises appelées à désigner un ou des représentants ;

2° Au chef de chaque entreprise extérieure de désigner nominativement les représentants de son entreprise.
