Article R4623-18 of the French Labour Code

When the dismissal or contractual termination of the employment contract of an occupational health physician is envisaged, or in the event of the termination of his fixed-term employment contract in the cases provided for in article L. 4623-5-1, the social and economic committee, the inter-company committee or the supervisory commission as well as the board of directors, as the case may be, shall give their opinion after hearing the interested party. The prior interview provided for in article L. 1232-2 precedes the consultation of the body.

Lorsqu’est envisagé le licenciement ou la rupture conventionnelle du contrat de travail d’un médecin du travail, ou en cas de rupture de son contrat de travail à durée déterminée dans les cas prévus à l’article L. 4623-5-1, le comité social et économique, le comité interentreprises ou la commission de contrôle ainsi que le conseil d’administration, selon le cas, se prononcent après audition de l’intéressé. L’entretien préalable prévu à l’article L. 1232-2 précède la consultation de l’instance.
