Article R4624-28-2 of the French Labour Code

For the purposes of organising the visit provided for in article L. 4624-2-1, the employer shall inform his occupational health and prevention service, as soon as he is aware of it, of the cessation of exposure of one of the company’s workers to particular health or safety risks justifying enhanced individual monitoring, of his departure or of his retirement. It shall immediately notify the worker concerned of the transmission of this information.

When a worker considers that he meets the conditions defined in article R. 4624-28-1 and has not been notified of the transmission of this information by the employer, he may, during the month preceding the date of cessation of exposure or his departure and up to six months after cessation of exposure, request to benefit from this visit directly from his occupational health and prevention service. He must inform his employer of his request.

Informed of the cessation of exposure, the departure or the retirement of the worker, the occupational health and prevention service determines, by any means, whether the worker fulfils the conditions defined in article R. 4624-28-1 and organises the visit when it considers them to be fulfilled.

Pour l’organisation de la visite prévue à l’article L. 4624-2-1, l’employeur informe son service de prévention et de santé au travail, dès qu’il en a connaissance, de la cessation de l’exposition d’un des travailleurs de l’entreprise à des risques particuliers pour sa santé ou sa sécurité justifiant un suivi individuel renforcé, de son départ ou de sa mise à la retraite. Il avise sans délai le travailleur concerné de la transmission de cette information.

Lorsqu’un travailleur estime remplir les conditions définies à l’article R. 4624-28-1 et n’a pas été avisé de la transmission de cette information par l’employeur, il peut, durant le mois précédant la date de la cessation de l’exposition ou son départ et jusqu’à six mois après la cessation de l’exposition, demander à bénéficier de cette visite directement auprès de son service de prévention et de santé au travail. Il informe son employeur de sa démarche.

Informé de la cessation de l’exposition, du départ ou de la mise à la retraite du travailleur, le service de prévention et de santé au travail détermine, par tout moyen, si le travailleur remplit les conditions définies à l’article R. 4624-28-1 et organise la visite lorsqu’il les estime remplies.
