Article R4624-7 of the French Labour Code

In the performance of his duties, the occupational physician may, at the employer’s expense, take samples or arrange for samples to be taken and measurements to be taken for analysis purposes. He may also arrange for any analyses or measurements he deems necessary to be carried out by an authorised body. In the event of disagreement between the employer and the occupational physician, the decision is taken by the labour inspector, after consulting the occupational physician inspector.

The occupational physician notifies the employer, who informs the workers concerned and the social and economic committee, of any risks and the protective measures to be taken.

Dans l’exercice de ses fonctions, le médecin du travail peut, aux frais de l’employeur, réaliser ou faire réaliser des prélèvements et des mesures aux fins d’analyses. Il peut également faire procéder à des analyses ou mesures qu’il estime nécessaires par un organisme habilité. En cas de désaccord entre l’employeur et le médecin du travail, la décision est prise par l’inspecteur du travail, après avis du médecin inspecteur du travail.

Le médecin du travail avertit l’employeur, qui informe les travailleurs concernés ainsi que le comité social et économique, des risques éventuels et des moyens de protection dont il doit être fait usage.
