I.-The partial exemption from financial penalties provided for in IV of Article L. 464-2 is granted when the following conditions are met:
1° The applicant satisfies the conditions laid down in article R. 464-5-4;
2° It discloses its participation in a practice prohibited by Article L. 420-1;
3° It provides information that has significant added value in terms of establishing the existence of the practice in question, compared with the information already in the possession of the Directorate-General for Competition, Consumer Affairs and Fraud Control or the Competition Authority at the time the request is made.
II.-When a party to a request for information is a party to a practice prohibited by Article L.
II.-Where an applicant is the first to provide decisive information enabling the Authority to establish additional factual elements leading to an increase in the financial penalties imposed on the participants in the practice in question compared with those that would have been imposed in the absence of such information, the Competition Authority will not take it into account in determining the amount of the penalty imposed on the applicant that provided the information.
