Article R*49-24 of the French Code of Criminal Procedure

When the plea that a legislative provision infringes the rights and freedoms guaranteed by the Constitution is raised by a detainee, in support of a request that may be made by handing it to the head of the prison, the separate written statement of reasons may also be handed to the head of the prison. This document is stamped by the prison governor, indicating the day on which it was handed in, and the original or a copy is sent without delay to the registry of the court hearing the case.

Lorsque le moyen tiré de ce qu’une disposition législative porte atteinte aux droits et libertés garantis par la Constitution est soulevé par une personne détenue, à l’appui d’une demande qui peut être formée par remise au chef de l’établissement pénitentiaire, l’écrit distinct et motivé peut également être remis au chef de l’établissement pénitentiaire. Cet écrit est visé par ce dernier, avec l’indication du jour du dépôt, et il est adressé sans délai, en original ou en copie, au greffe de la juridiction saisie.
