Article R*49-25 of the French Code of Criminal Procedure

The court shall rule without delay, in accordance with the rules of procedure applicable to it, on the referral of the priority question of constitutionality, after the public prosecutor and the parties, having been heard or called, have presented their observations on the priority question of constitutionality.

The court may, however, rule without taking the observations of the public prosecutor and the parties if it is clear from the separate pleading that there are no grounds for referring the priority question of constitutionality.

If they are submitted in writing, the observations of the public prosecutor and the other parties must appear in a separate written statement setting out the reasons. Otherwise, they cannot be attached to the decision referring the question to the Cour de cassation.

La juridiction statue sans délai, selon les règles de procédure qui lui sont applicables, sur la transmission de la question prioritaire de constitutionnalité, après que le ministère public et les parties, entendues ou appelées, ont présenté leurs observations sur la question prioritaire de constitutionnalité.

La juridiction peut toutefois statuer sans recueillir les observations du ministère public et des parties s’il apparaît de façon certaine, au vu du mémoire distinct, qu’il n’y a pas lieu de transmettre la question prioritaire de constitutionnalité.

Dès lors qu’elles sont présentées par écrit, les observations du ministère public et des autres parties doivent figurer dans un écrit distinct et motivé. A défaut, elles ne peuvent être jointes à la décision transmettant la question à la Cour de cassation.
