Article R49-5 of the French Code of Criminal Procedure

The automatic increase in fixed fines provided for in the second paragraph of Article 529-2 and the second paragraph of Article 529-5 is recorded by the officer of the public prosecutor’s office, who mentions it on the enforcement order provided for in the first paragraph of Article 530.

The enforcement order shall mention in an appendix, for each fine, the identity and address of the offender, the place and date of the offence and the amount of the increased fixed fine.

The enforcement order, signed by the public prosecutor, is sent to the principal accounting officer of the Treasury.

La majoration de plein droit des amendes forfaitaires prévue par le deuxième alinéa de l’article 529-2 et le deuxième alinéa de l’article 529-5 est constatée par l’officier du ministère public qui la mentionne sur le titre exécutoire prévu par l’alinéa premier de l’article 530.

Le titre exécutoire mentionne en annexe, pour chaque amende, l’identité et le domicile du contrevenant, le lieu et la date de la contravention et le montant de l’amende forfaitaire majorée.

Le titre exécutoire, signé par l’officier du ministère public, est transmis au comptable principal du Trésor.
