Article R5111-5 of the French Labour Code

The agreements referred to in article R. 5111-1, with the exception of those concluded in connection with a proposed redundancy of less than ten employees within the same thirty-day period, are submitted, prior to their conclusion, for the opinion of :

1° To the Commission nationale de la négociation collective, de l’emploi et de la formation professionnelle (National Commission for Collective Bargaining, Employment and Vocational Training) when they fall within the remit of the Minister for Employment ;

2° To the regional coordination committee for employment and vocational training when they fall within the remit of the regional prefect;

3° To the Commission Départementale de l’Emploi et de l’Insertion (Departmental Employment and Integration Commission) when they fall within the remit of the Prefect.

Article R5111-5

Les conventions mentionnées à l’article R. 5111-1, à l’exception de celles conclues à l’occasion d’un projet de licenciement de moins de dix salariés dans une même période de trente jours, sont soumises, avant leur conclusion, pour avis :

1° A la Commission nationale de la négociation collective, de l’emploi et de la formation professionnelle lorsqu’elles relèvent de la compétence du ministre chargé de l’emploi ;

2° Au comité de coordination régional de l’emploi et de la formation professionnelle lorsqu’elles relèvent de la compétence du préfet de région ;

3° A la commission départementale de l’emploi et de l’insertion lorsqu’elles relèvent de la compétence du préfet.
