The department to which the authorised agent reports informs the sample holder of the results of the sample analysis.
If the analysis establishes that the sample does not comply with the regulations, the holder is informed that he can have a counter-analysis carried out, at his own expense, by a laboratory offering guarantees of independence, competence and impartiality.
Before any analysis, this laboratory checks the integrity of the seal affixed to the sample it has received. It carries out the analysis in compliance with the applicable regulations.
If the counter-analysis invalidates the result of the first analysis, the keeper may have an analysis of the third sample carried out at his own expense by the national reference laboratory, within the meaning of Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29 April 2004 as amended on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules, competent in the field of analysis in question.
The result of this last analysis is the same as that of the first analysis.
The result of this last analysis is the only one taken into account when deciding on the measures to be taken following the inspection.
If the owner or keeper decides not to have the third sample analysed by the national reference laboratory, the result of the first official analysis takes precedence over that of the counter-analysis.
