Article R5122-10 of the French Labour Code

The administrative authority shall request the employer to reimburse the Agence de service et de paiement, within a period of not less than thirty days, the sums paid in respect of the partial activity allowance in the event of overpayment, in particular where the conditions for their grant have not been complied with, or in the event of non-compliance by the company, without a legitimate reason, with the commitments mentioned in II of article R. 5122-9.

Repayment may not be required if it is incompatible with the economic and financial situation of the company.

Article R5122-10

L’autorité administrative demande à l’employeur le remboursement à l’Agence de service et de paiement, dans un délai ne pouvant être inférieur à trente jours, des sommes versées au titre de l’allocation d’activité partielle en cas de trop perçu, notamment lorsque les conditions mises à leur octroi n’ont pas été respectées, ou en cas de non-respect par l’entreprise, sans motif légitime, des engagements mentionnés au II de l’article R. 5122-9.

Le remboursement peut ne pas être exigé s’il est incompatible avec la situation économique et financière de l’entreprise.
