Article R5124-40 of the French Public Health Code

For the purposes of calculating the number of staff referred to in Articles R. 5124-38 and R. 5124-39, account is taken of persons engaged in the following operations:

1° Manufacturing and import operations and all related controls ;

2° Warehousing, preparation of orders and packaging, and, in the case of gases for medical use, transport to the establishment’s storage tanks or premises referred to in Article R. 5124-7;

3° Batch tracking, complaints handling, product withdrawals and returns.

Article R5124-40

Pour le calcul de l’effectif des personnels mentionnés aux articles R. 5124-38 et R. 5124-39, il est tenu compte des personnes qui se livrent aux opérations suivantes :

1° Opérations de fabrication et d’importation et tous contrôles y afférents ;

2° Magasinage, préparation des commandes et emballage, et, en ce qui concerne le gaz à usage médical, le transport jusqu’aux réservoirs ou locaux de stockage de l’établissement mentionnés à l’article R. 5124-7 ;

3° Suivi des lots, traitement des réclamations, retraits et retours des produits.
