Article R5125-39 of the French Public Health Code

The replacement of a pharmacist holding a dispensary other than those mentioned in article L. 5125-19 is carried out under the following conditions:

1° For an absence of between four months and one year, the replacement may be carried out :

a) By a pharmacist registered on the roll of section D of the Ordre national des pharmaciens and who has no other professional activity for the duration of the replacement ;

b) By an assistant pharmacist from the same pharmacy;

2° For an absence of between one and four months, the replacement may, in addition, be carried out :

a) By a pharmacist who has applied to be entered on the roll of one of the sections of the Ordre National des Pharmaciens, pending a decision on his application, and who has no other professional activity during the period of replacement ;

b) By a pharmacy student of one of the nationalities specified in 2° of article L. 4221-1, who has completed the fifth year of studies for the State diploma of doctor of pharmacy and a six-month period of professional practice as part of the third cycle of his studies. In this case, the president of the regional council of the order of pharmacists issues the student with a certificate to be given to the pharmacist he is replacing, certifying that he fulfils the conditions laid down for this replacement: the issue of this certificate is subject, as far as the evidence of the studies carried out is concerned, to a certificate issued to the student by the director of the training and research unit with which he is registered with a view to obtaining the State diploma of doctor of pharmacy. This certificate is valid for one year throughout the French Republic. It may be renewed under the same conditions, on proof of continuation of the same studies;

3° When the absence does not exceed one month, the replacement may be provided by one of the persons mentioned in 1° and 2° above or by a pharmacist with joint ownership of the same pharmacy.

Article R5125-39

Le remplacement d’un pharmacien titulaire d’une officine autre que celles mentionnées à l’article L. 5125-19 est effectué dans les conditions suivantes :

1° Pour une absence comprise entre quatre mois et un an, le remplacement peut être effectué :

a) Par un pharmacien inscrit au tableau de la section D de l’ordre national des pharmaciens et n’ayant pas d’autre activité professionnelle pendant la durée du remplacement ;

b) Par un pharmacien adjoint de la même officine ;

2° Pour une absence comprise entre un et quatre mois, le remplacement peut, en outre, être effectué :

a) Par un pharmacien ayant sollicité son inscription au tableau de l’une des sections de l’ordre national des pharmaciens en attendant qu’il soit statué sur sa demande, et n’ayant pas d’autre activité professionnelle pendant la durée du remplacement ;

b) Par un étudiant en pharmacie de l’une des nationalités prévues au 2° de l’article L. 4221-1, ayant validé la cinquième année d’études en vue du diplôme d’Etat de docteur en pharmacie et un stage de six mois de pratique professionnelle dans le cadre du troisième cycle de ses études. Dans ce cas, le président du conseil régional de l’ordre des pharmaciens délivre à l’étudiant un certificat à remettre au pharmacien qu’il remplace, attestant qu’il remplit les conditions prévues pour ce remplacement : l’établissement de ce certificat est subordonné, pour ce qui concerne la constatation des études effectuées, à une attestation délivrée à l’étudiant par le directeur de l’unité de formation et de recherche auprès de laquelle il est inscrit en vue de l’obtention du diplôme d’Etat de docteur en pharmacie. Ce certificat est valable un an sur l’ensemble du territoire de la République française. Il peut être renouvelé dans les mêmes conditions, sur justification de la poursuite des mêmes études ;

3° Lorsque l’absence n’excède pas un mois, le remplacement peut être assuré par l’une des personnes mentionnées aux 1° et 2° ci-dessus ou par un pharmacien cotitulaire de la même officine.
