Article R5126-30 of the French Public Health Code

I. Silence on the part of the Director General of the Regional Health Agency on the expiry of a period of four months from the date of receipt of the application for authorisation accompanied by a complete file, will be deemed to constitute tacit authorisation.

In the event of an incomplete file, the Director General of the Regional Health Agency may ask the applicant for the additional information required to examine the application. The period provided for in the first paragraph is then suspended until this information has been received.

II – For the application of I to the Institution Nationale des Invalides, the Minister for Veterans Affairs exercises the powers of the Director General of the Regional Health Agency.

I.-Le silence gardé par le directeur général de l’agence régionale de santé, à l’expiration d’un délai de quatre mois à compter de la date de réception de la demande d’autorisation accompagnée d’un dossier complet, vaut autorisation tacite.


En cas de dossier incomplet, le directeur général de l’agence régionale de santé peut requérir du demandeur les informations complémentaires nécessaires à l’instruction de la demande. Le délai prévu au premier alinéa est alors suspendu jusqu’à réception de ces informations.


II.-Pour l’application du I à l’Institution nationale des invalides, le ministre chargé des anciens combattants exerce les attributions du directeur général de l’agence régionale de santé.
