For the application of II of article L. 5126-4, the authorisation may only be suspended, except in the event of an immediate danger to public health, or withdrawn once the administrative authority competent to issue the authorisation has informed, as appropriate, the natural person holding the authorisation to operate the establishment or the legal representative of the legal entity concerned of the nature of the infringements observed and has given him formal notice to put an end to them within a specified period. The competent administrative authority sends a copy of the formal notice to the pharmacist in charge of the establishment. Reasons are given for the withdrawal or suspension of the authorisation. These decisions may concern all or part of the authorisation.
Where the competent administrative authority is not the Director General of the Regional Health Agency, a copy of the decisions is sent to the latter.
