Article R5126-9-1 of the French Public Health Code

I.-Pharmacists and nurses practising within an in-house pharmacy may prescribe and administer the vaccines mentioned in the decrees provided for respectively in 6° and 7° of article L. 5126-1 to persons whose age conditions and, where applicable, pathologies are specified by these same decrees.

II – The prescription and administration of vaccines by the professionals mentioned in I are carried out under the following conditions:

1° The pharmacist declares his activity of administering or prescribing and administering vaccines, by any means giving a date certain on receipt of the declaration, to the competent authority of the pharmacists’ association to which he belongs. The declaration must state the pharmacist’s surname, first name and identification number in the sectorial reference register of natural persons referred to in article L. 1470-4.

If the pharmacist has not received training in the administration or prescription of vaccines as part of his initial training, the declaration must be accompanied by a training certificate issued by a training organisation or structure that complies with the educational objectives set by order of the Minister for Health, enabling the pharmacist to know, in particular, for prescribing, the characteristics of vaccine-preventable diseases, the traceability of vaccinations and the main recommendations of the vaccination calendar and, for administration, the normative framework and public health objectives of vaccination, injection methods and post-injection monitoring.

When the pharmacist has already completed training in the administration of vaccines, provided by a training organisation or structure that complies with the educational objectives and conditions laid down in the order issued in application of the previous paragraph, or the specific training in vaccination against covid-19 provided under the conditions laid down in application of law no. 2020-546 of 11 May 2020 extending the state of health emergency and supplementing its provisions or law no. 2021-689 of 31 May 2021 relating to the management of the end of health crises, he/she is exempt from following the part of the training relating to the administration of vaccines. In this case, the declaration must be accompanied by a certificate of completion of one or other of these training courses;

2° The nurse declares that he or she prescribes vaccines in accordance with the procedures laid down in I of Article R. 4311-5-1;

3° The activity of administering or prescribing and administering vaccines may begin as soon as the declarations mentioned in 1° of I of this article and in the second paragraph of I of article R. 4311-5-1 have been received. This activity is carried out by the health professionals mentioned in I of this article in compliance with the specifications relating to the technical conditions laid down for the pharmacy to carry out this activity, the content of which is defined by order of the Minister for Health.

III – The health professionals mentioned in I may prescribe and administer the vaccines on the lists set out in the orders provided for in 6° and 7° of article L. 5126-1:

1° Persons under the care of the establishment, service or organisation to which the in-house pharmacy belongs, whose age conditions and, where applicable, pathologies are specified by these decrees ;

2° Staff working in the establishment, department or organisation to which the in-house pharmacy belongs, whose age requirements and, where applicable, medical conditions are specified by these decrees.

IV – The professionals referred to in I shall enter in the health record, vaccination record or shared medical record of the person vaccinated their full name, the name of the vaccine administered, the date of administration and the batch number. If this information is not recorded, they will issue the vaccinated person with a vaccination certificate containing this information.

In the absence of a shared medical file, and subject to the consent of the person vaccinated, they will pass this information on to their GP. This information is transmitted via a secure health messaging system that meets the conditions laid down in article L. 1470-5, where such a system exists.

Article R5126-9-1

I.-Les pharmaciens et les infirmiers exerçant au sein d’une pharmacie à usage intérieur peuvent prescrire et administrer les vaccins mentionnés dans les arrêtés prévus respectivement au 6° et au 7° de l’article L. 5126-1 aux personnes dont les conditions d’âge et, le cas échéant, les pathologies sont précisées par ces mêmes arrêtés.

II.-La prescription et l’administration des vaccins par les professionnels mentionnés au I sont réalisées dans les conditions suivantes :

1° Le pharmacien déclare son activité d’administration ou de prescription et d’administration de vaccins, par tout moyen donnant date certaine à la réception de la déclaration, auprès de l’autorité compétente du conseil de l’ordre des pharmaciens dont il relève. La déclaration mentionne les nom et prénom d’exercice et le numéro d’identification du pharmacien au répertoire sectoriel de référence des personnes physiques mentionné à l’article L. 1470-4.

Lorsque le pharmacien n’a pas suivi d’enseignement relatif à l’administration ou à la prescription de vaccins dans le cadre de sa formation initiale, la déclaration est accompagnée d’une attestation de formation délivrée par un organisme ou une structure de formation respectant les objectifs pédagogiques fixés par arrêté du ministre chargé de la santé, permettant au pharmacien de connaître notamment, pour la prescription, les caractéristiques des maladies à prévention vaccinale, la traçabilité des vaccinations et les principales recommandations du calendrier des vaccinations et, pour l’administration, le cadre normatif et les objectifs de santé publique de la vaccination, les modes d’injection et le suivi post-injection.

Lorsque le pharmacien a déjà suivi la formation à l’administration de vaccins, assurée par un organisme ou une structure de formation respectant les objectifs pédagogiques et les conditions fixés dans l’arrêté pris en application de l’alinéa précédent, ou la formation spécifique à la vaccination contre la covid-19 assurée dans les conditions prévues en application de la loi n° 2020-546 du 11 mai 2020 prorogeant l’état d’urgence sanitaire et complétant ses dispositions ou de la loi n° 2021-689 du 31 mai 2021 relative à la gestion de la sortie de crise sanitaire, il est dispensé du suivi de la partie de la formation relative à l’administration de vaccins. Dans ce cas, la déclaration est accompagnée d’une attestation de suivi de l’une ou l’autre de ces formations ;

2° L’infirmier ou l’infirmière déclare son activité de prescription de vaccins selon les modalités prévues au I de l’article R. 4311-5-1 ;

3° L’activité d’administration ou de prescription et d’administration de vaccins peut commencer dès la réception des déclarations mentionnées au 1° du I du présent article et au deuxième alinéa du I de l’article R. 4311-5-1. Cette activité est réalisée par les professionnels de santé mentionnés au I du présent article dans le respect du cahier des charges relatif aux conditions techniques fixées à la pharmacie pour exercer cette activité, dont le contenu est défini par arrêté du ministre chargé de la santé.

III.-Sont susceptibles de se voir prescrire et administrer par les professionnels de santé mentionnés au I les vaccins figurant sur les listes fixées par les arrêtés prévus aux 6° et 7° de l’article L. 5126-1 :

1° Les personnes prises en charge par l’établissement, le service ou l’organisme dont relève la pharmacie à usage intérieur, dont les conditions d’âge et, le cas échéant, les pathologies sont précisées par ces arrêtés ;

2° Les personnels exerçant au sein de l’établissement, du service ou de l’organisme dont relève la pharmacie à usage intérieur, dont les conditions d’âge et, le cas échéant, les pathologies sont précisées par ces arrêtés.

IV.-Les professionnels mentionnés au I inscrivent dans le carnet de santé, le carnet de vaccination ou le dossier médical partagé de la personne vaccinée ses nom et prénom d’exercice, la dénomination du vaccin administré, la date de son administration et son numéro de lot. A défaut de cette inscription, ils délivrent à la personne vaccinée une attestation de vaccination qui comporte ces informations.

En l’absence de dossier médical partagé et sous réserve du consentement de la personne vaccinée, ils transmettent ces informations à son médecin traitant. La transmission de cette information s’effectue par messagerie sécurisée de santé répondant aux conditions prévues à l’article L. 1470-5, lorsqu’elle existe.
