Article R5127-3 of the French Public Health Code

The request for an extension of the consignment order referred to in the second paragraph of article L. 5127-2, presented by the public health inspecting pharmacists, is brought before the president of the judicial court within whose jurisdiction the place where the products have been consigned is located or before the magistrate delegated for this purpose, who is seised without formality.

The holder of the consigned products is notified by any means of the order extending the consignment.

The request to release the consignment, referred to in the third paragraph of article L. 5127-2, is submitted without formality by the holder of the consigned products.

The president of the judicial court or the magistrate delegated by him will hear the observations of the administration before making a decision.

The consignment is automatically lifted by the inspectors once it has been established that the consigned products comply with the regulations in force.

Article R5127-3

La requête tendant à la prorogation de la mesure de consignation, mentionnée au deuxième alinéa de l’article L. 5127-2, présentée par les pharmaciens inspecteurs de santé publique est portée devant le président du tribunal judiciaire dans le ressort duquel est situé le lieu où les produits ont été consignés ou devant le magistrat délégué à cet effet, qui est saisi sans forme.

L’ordonnance de prorogation de la mesure de consignation est notifiée par tous moyens au détenteur des produits consignés.

La requête tendant à la mainlevée de la mesure de consignation, mentionnée au troisième alinéa de l’article L. 5127-2, est présentée sans forme par le détenteur des produits consignés.

Le président du tribunal judiciaire ou le magistrat délégué par lui recueille les observations de l’administration avant de se prononcer.

La consignation est levée de plein droit par les inspecteurs dès lors que la conformité des produits consignés aux réglementations en vigueur est établie.
