Any person referred to in I and III of article R. 519-4 shall ensure that its staff meet the conditions of professional competence set out in articles R. 519-8, R. 519-9 and R. 519-10 and applicable to itself, before carrying out any intermediation activity.
Staff are defined as the natural persons who work for intermediaries and who directly carry out the intermediation or advisory activity referred to in article L. 519-1-1 , as well as the natural persons who directly manage or supervise the aforementioned natural persons. Excluded from this definition are natural persons employed under a work-linked training contract referred to in Articles L. 6221-1 and L. 6325-1 of the Labour Code, for the duration of this contract, provided that they only take part in the aforementioned activities in the presence and under the direction of an employee with the required training or professional experience.
Notwithstanding the provisions of the first paragraph, banking and payment services intermediaries shall ensure that their staff meet the conditions of professional competence set out in articles R. 519-8, R. 519-9 and II of article R. 519-10 applicable to them, within six months of taking up their post, provided that during this period they occupy a suitable position and carry out their activity under the responsibility of a member of staff meeting these same conditions.
However, for the staff of the intermediaries mentioned in articles R. 519-8 and R. 519-9, the professional training mentioned in 2° of I and II of the same articles may be adapted according to the activities carried out under the conditions defined by order of the Minister responsible for the economy.
