Article R521-12 of the French Commercial code

As an exception to the first paragraph of article R. 521-11, the registration takes effect for:

-ten years for the preferential right of the seller of a business, the pledge of a business, maritime and river mortgages and decrees issued pursuant to articles L. 184-1 or L. 511-11 of the Construction and Housing Code relating to a building in which a business is operated for the purposes of accommodation;

-four years for the preferential right of the Treasury;

two years and six months for the social security lien; registration is non-renewable;

> -the term set by the decision of the Minister of Finance.
-the period set by the court decision, for the inalienability measure;

-three years for the provisional publication of the judicial pledge of the business.

Article R521-12

Par exception au premier alinéa de l’article R. 521-11, l’inscription produit effet durant :

-dix ans pour le privilège du vendeur de fonds de commerce, le nantissement du fonds de commerce, les hypothèques maritimes et fluviales et les arrêtés pris en application des articles L. 184-1 ou L. 511-11 du code de la construction et de l’habitation portant sur un immeuble dans lequel est exploité un fonds de commerce à des fins d’hébergement ;

-quatre ans pour le privilège du Trésor ;

-deux ans et six mois pour le privilège de la sécurité sociale, l’inscription n’est pas renouvelable ;

-la durée fixée par la décision du tribunal, pour la mesure d’inaliénabilité ;

-trois ans pour la publicité provisoire du nantissement judiciaire du fonds de commerce.
