Article R5211-1-1 of the French General Code of Local Authorities

I. – For the distribution of seats on the deliberative body, the population figure to be referred to is that of the municipal population authenticated in the year preceding that of the general renewal of the municipal councils of the member municipalities in accordance with VII of Article L. 5211-6-1.

II. – Between two general renewals of municipal councils, the population figure to be referred to, for the allocation of seats on the deliberative body, is that of the municipal population authenticated on 1 January of the current year, in the following cases:

1° Creation of a public establishment of inter-municipal cooperation with its own tax status;

2° Merger of public establishments of inter-municipal cooperation, at least one of which has its own tax status;

3° Transformation of a public establishment of inter-municipal cooperation with its own tax status with extension of the perimeter;

4° Extension of the perimeter of a public establishment of inter-municipal cooperation with its own tax status by the integration of one or more communes or the modification of the territorial boundaries of a member commune.

III. – Variations in the population of the commune recorded during the term of office by authenticated censuses may not have the effect of modifying the number of seats allocated to the commune concerned for the duration of the term of office of the deliberative body.

Article R5211-1-1

I. – Pour la répartition des sièges au sein de l’organe délibérant, le chiffre de la population auquel il convient de se référer est celui de la population municipale authentifiée l’année précédant celle du renouvellement général des conseils municipaux des communes membres conformément au VII de l’article L. 5211-6-1.

II. – Entre deux renouvellements généraux de conseils municipaux, le chiffre de la population auquel il convient de se référer, pour la répartition des sièges au sein de l’organe délibérant, est celui de la population municipale authentifiée au premier janvier de l’année en cours, dans les cas suivants :

1° Création d’un établissement public de coopération intercommunale à fiscalité propre ;

2° Fusion d’établissements publics de coopération intercommunale dont un au moins est à fiscalité propre ;

3° Transformation d’un établissement public de coopération intercommunale à fiscalité propre avec extension de périmètre ;

4° Extension du périmètre d’un établissement public de coopération intercommunale à fiscalité propre par l’intégration d’une ou plusieurs communes ou la modification des limites territoriales d’une commune membre.

III. – Les variations de la population communale constatées en cours de mandat par des recensements authentifiés ne peuvent avoir pour effet de modifier le nombre de sièges attribués à la commune concernée pour la durée du mandat de l’organe délibérant.
