Article R5211-25 of the French General Code of Local Authorities

The election of the representatives mentioned in article R. 5211-23 shall take place by post.

The ballot papers shall be sent or deposited at the prefecture of the department, in accordance with the procedures laid down by the order provided for in article R. 5211-23.

Each ballot paper is placed in a double envelope: the inner envelope must not bear any indication or distinctive sign; the outer envelope must bear the words: “Election of the members of the departmental commission for inter-communal cooperation”, the indication of the college to which the interested party belongs, his name, position and signature.

The results of the election are declared by a commission comprising:

a) The prefect or his delegate, chairman;

b) Three mayors appointed by the prefect, on the proposal of the departmental association of mayors;

c) A departmental councillor appointed by the prefect, on the proposal of the chairman of the departmental council, or, in Corsica, a councillor to the Assembly of Corsica appointed by the prefect on the proposal of the chairman of that assembly ;

d) A regional councillor appointed by the prefect, on the proposal of the president of the regional council, or, in Corsica, an executive councillor appointed by the prefect on the proposal of the president of the executive council.

The secretariat of the commission is provided by an agent of the prefecture.

A representative of each list may supervise the ballot counting operations.

Seats are allocated to candidates in the order of presentation on each list.

If several lists have the same average for the allocation of the last seat, it goes to the list that has obtained the highest number of votes. In the event of a tie, the seat is awarded to the oldest candidate eligible to be declared elected.

The results of the election are published at the behest of the prefect. They may be challenged before the administrative court within ten days of such publication by any elector, by the candidates and by the prefect.

L’élection des représentants mentionnés à l’article R. 5211-23 a lieu par correspondance.

Les bulletins de vote sont adressés ou déposés à la préfecture du département, selon les modalités fixées par l’arrêté prévu à l’article R. 5211-23.

Chaque bulletin est mis sous double enveloppe : l’enveloppe intérieure ne doit comporter aucune mention ni signe distinctif ; l’enveloppe extérieure doit porter la mention : ” Election des membres de la commission départementale de la coopération intercommunale “, l’indication du collège auquel appartient l’intéressé, son nom, sa qualité et sa signature.

Les résultats de l’élection sont proclamés par une commission comprenant :

a) Le préfet ou son délégué, président ;

b) Trois maires désignés par le préfet, sur proposition de l’association départementale des maires ;

c) Un conseiller départemental désigné par le préfet, sur proposition du président du conseil départemental, ou, en Corse, un conseiller à l’Assemblée de Corse désigné par le préfet sur proposition du président de cette assemblée ;

d) Un conseiller régional désigné par le préfet, sur proposition du président du conseil régional, ou, en Corse, un conseiller exécutif désigné par le préfet sur proposition du président du conseil exécutif.

Le secrétariat de la commission est assuré par un agent de la préfecture.

Un représentant de chaque liste peut contrôler les opérations de dépouillement des bulletins.

Les sièges sont attribués aux candidats dans l’ordre de présentation sur chaque liste.

Si plusieurs listes ont la même moyenne pour l’attribution du dernier siège, celui-ci revient à la liste qui a obtenu le plus grand nombre de suffrages. En cas d’égalité de suffrages, le siège est attribué au plus âgé des candidats susceptibles d’être proclamés élus.

Les résultats de l’élection sont publiés à la diligence du préfet. Ils peuvent être contestés devant le tribunal administratif dans les dix jours qui suivent cette publication par tout électeur, par les candidats et par le préfet.
