Article R5221-16 of the French Labour Code

If the foreign national does not reside in France, the application must be sent to:
1° If the employer is established in France, to the prefect of the département in which the establishment to which the foreign national will be attached is located or in which the home of the private individual proposing to employ the foreign national is located;
2° If the employer is established outside France, either to the prefect of the département in which the employer’s co-contractor is located if the foreign national is seconded under 1° of article L. 1262-1, or to the prefect of the département in which the host establishment is located if the foreign national is seconded under either 2° of article L. 1262-1 or article L. 1262-1. 1262-1, or to the prefect of the département of the host establishment when the foreign national is seconded under either 2° of article L. 1262-1 or article L. 1262-2. If the foreign national has an itinerant job, the request is sent to the prefect of the département where he/she first works. In other cases, the request is sent to the prefect of the département of the place of employment.

Lorsque l’étranger ne réside pas sur le territoire national, la demande est adressée :
1° Lorsque l’employeur est établi en France, au préfet du département dans lequel se trouve l’établissement auquel l’étranger sera rattaché ou dans lequel se trouve le domicile du particulier qui se propose de l’embaucher ;
2° Lorsque l’employeur est établi hors de France, soit au préfet du département où se trouve le cocontractant de l’employeur lorsque l’étranger est détaché dans le cadre du 1° de l’article L. 1262-1, soit au préfet du département de l’établissement d’accueil lorsque l’étranger est détaché dans le cadre soit du 2° de l’article L. 1262-1, soit de l’article L. 1262-2. Si l’étranger exerce un emploi itinérant, la demande est adressée au préfet du département de son premier lieu d’emploi. Dans les autres cas, la demande est adressée au préfet du département du lieu d’emploi.
