Article R526-20-1 of the French Commercial code

When the individual limited liability entrepreneur transfers to the jurisdiction of another court the establishment where the professional activity in respect of which he has made a declaration of assignment of assets is carried out or, in the absence of an establishment, the residential premises where the business is based, he shall apply for a new registration through the single body mentioned in article R. 123-1 and shall indicate, together with this application, the place and register of his previous registration.

The newly competent registrar shall request, within one clear working day of the new registration, the registrar of the court within whose jurisdiction the business was carried on to proceed with the transfer within one clear working day of receipt of his request. The clerk of the court previously responsible will automatically amend or delete the sole trader’s registration from its register. Each registry informs the individual entrepreneur with limited liability, via the aforementioned single body.

Lorsque l’entrepreneur individuel à responsabilité limitée transfère dans le ressort d’un autre tribunal l’établissement où est exercée l’activité professionnelle au titre de laquelle il a effectué une déclaration d’affectation de patrimoine ou, à défaut d’établissement, le local d’habitation où l’entreprise est fixée, il demande une nouvelle immatriculation par l’intermédiaire de l’organisme unique mentionné à l’article R. 123-1 et indique, conjointement à cette demande, le lieu et le registre de son immatriculation antérieure.

Le greffier nouvellement compétent demande, dans le délai d’un jour franc ouvrable à compter de la nouvelle immatriculation, au greffier du tribunal dans le ressort duquel était exercée l’activité de procéder au transfert dans le délai d’un jour franc ouvrable à compter de la réception de sa demande. Le greffier antérieurement compétent procède d’office à la modification ou à la radiation de l’immatriculation de l’entrepreneur individuel de son registre. Chaque greffe informe l’entrepreneur individuel à responsabilité limitée, par l’intermédiaire de l’organisme unique susvisé.
