Article R53-38 of the French Code of Criminal Procedure

The technical characteristics of the means of telecommunication used must ensure faithful, loyal and confidential retransmission with regard to third parties.

Any technical incident that has disrupted a transmission must be mentioned in the reports provided for in article R. 53-37.

A joint order of the Minister of Justice and the Minister of the Interior specifies the characteristics specific to audiovisual telecommunication means or concerning sound telecommunication means other than the telephone.

Article R53-38

Les caractéristiques techniques des moyens de télécommunication utilisés doivent assurer une retransmission fidèle, loyale et confidentielle à l’égard des tiers.

Tout incident technique ayant perturbé une transmission doit être mentionné dans les procès-verbaux prévus par l’article R. 53-37.

Un arrêté conjoint du garde des sceaux, ministre de la justice et du ministre de l’intérieur précise les caractéristiques propres aux moyens de télécommunication audiovisuelle ou concernant des moyens de télécommunication sonore autre que le téléphone.
