Article R531-31 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of 2° of Article L. 531-32, the French Office for the Protection of Refugees and Stateless Persons shall refer the matter to the competent Prefect, providing all the information required for verification, in order to ensure that the applicant is in fact eligible for readmission to the country where he or she enjoys refugee status.
This referral suspends the time limit laid down in Article R. 531-30.
Failing a response within two months, the Office shall rule on the merits.

Article R531-31

Pour l’application du 2° de l’article L. 531-32, l’Office français de protection des réfugiés et apatrides saisit le préfet compétent, en lui communiquant tous les éléments nécessaires aux vérifications, afin de s’assurer que le demandeur est effectivement réadmissible dans le pays où il bénéficie du statut de réfugié.
Cette saisine suspend le délai prévu à l’article R. 531-30.
A défaut de réponse dans un délai de deux mois, l’office statue au fond.
