Article R5312-40 of the French Labour Code

In addition to the data collected directly from the persons concerned, the information system is fed, within the framework of the purposes mentioned in Article R. 5312-38 and strictly limited to the information required, by:

1° The processing of personal data known as the “Nominative Social Declaration” mentioned inArticle 3 of Decree No. 2013-266 of 28 March 2013 on the Nominative Social Declaration;

2° The pre-employment declaration mentioned in Article R. 1221-17 ;

3° The automated processing of personal data known as the “Personal Training Account Information System” referred to in article R. 6323-13;

4° A file of legal notices identifying companies and their directors.

Outre les données directement collectées auprès des personnes concernées, le système d’information est alimenté, dans le cadre des finalités mentionnées à l’article R. 5312-38 et dans la stricte limite des informations nécessaires, par :

1° Le traitement de données à caractère personnel dénommé ” Déclaration sociale nominative ” mentionné par l’article 3 du décret n° 2013-266 du 28 mars 2013 relatif à la déclaration sociale nominative ;

2° La déclaration préalable à l’embauche mentionnée à l’article R. 1221-17 ;

3° Le traitement automatisé de données à caractère personnel dénommé ” Système d’information du compte personnel de formation ” mentionné à l’article R. 6323-13 ;

4° Un fichier d’annonces légales permettant d’identifier les entreprises et leurs dirigeants.
