Article R532-2 of the French Monetary and Financial Code

Where the applicant applies for authorisation as an investment firm or credit institution including the right to provide custody account keeping or clearing of financial instruments, the authorisation to provide this service or carry out this activity is issued as part of the authorisation procedure as an investment services provider.

If the applicant has been authorised as an investment firm or credit institution providing one or more investment services and is applying for authorisation to provide custody account keeping or clearing of financial instruments, the authorisation will be granted when the applicant’s authorisation is amended.

Lorsque le requérant demande un agrément d’entreprise d’investissement ou d’établissement de crédit comportant le droit d’exercer le service de tenue de compte conservation ou l’activité de compensation d’instruments financiers, l’habilitation à fournir ce service ou exercer cette activité est délivrée dans le cadre de la procédure d’agrément comme prestataire de services d’investissement.

Lorsque le requérant a été agréé en qualité d’entreprise d’investissement ou d’établissement de crédit fournissant un ou plusieurs services d’investissement et qu’il demande une habilitation pour le service de tenue de compte conservation ou l’activité de compensation d’instruments financiers, cette habilitation est délivrée dans le cadre de la modification de son agrément.
