Article R548-10 of the French Monetary and Financial Code

I.-When they present donation-based financing offers on their website that take the form of a collection open to the public, intermediaries in participative financing shall make available to the parties a standard contract that mentions the information provided for in 1° and a and d of 3° of Article R. 548-6. The use of this standard contract is not required for donation-based financing offers taking the form of a fundraising event that is not open to the public.

II-Participatory finance intermediaries presenting only donation-based financing offers on their website are only required to comply with the provisions of I of this Article, Article R. 548-4, 1°, a of 3° and a of 4° of Article R. 548-5 and 2° and 3° of Article R. 548-7 with regard to the information provided for in this section.

I.-Lorsqu’ils présentent sur leur site internet des offres de financement par dons prenant la forme d’une collecte ouverte au public, les intermédiaires en financement participatif mettent à la disposition des parties un contrat type mentionnant les informations prévues au 1° et aux a et d du 3° de l’article R. 548-6. Le recours à ce contrat type n’est pas requis pour les offres de financement par dons prenant la forme d’une collecte qui n’est pas ouverte au public.

II.-Les intermédiaires en financement participatif ne présentant sur leur site internet que des offres de financement par dons ne sont tenus de respecter, au titre des informations prévues par la présente section, que les dispositions du I du présent article, de l’article R. 548-4, du 1°, du a du 3° et du a du 4° de l’article R. 548-5 et des 2° et 3° de l’article R. 548-7.
