Article R55-5 of the French Code of Criminal Procedure

In the case provided for in the first paragraph of Article R. 55-4, the chief clerk shall send a copy of each criminal conviction statement to the accounting officer of the Directorate General of Public Finances no later than the second working day following the pronouncement of the decision.

In other cases, this statement is sent to the accountant of the Directorate-General of Public Finance at the same time as the decision is served.

These statements are sent under a simplified dispatch note, the model for which is jointly determined by the Minister of Justice and the Minister of Finance.

Sending these statements dispenses with the need to subsequently send an extract of the decision when it has become enforceable.

Dans le cas prévu par le premier alinéa de l’article R. 55-4, le greffier en chef adresse au comptable de la direction générale des finances publiques un exemplaire de chaque relevé de condamnation pénale au plus tard le deuxième jour ouvrable suivant le prononcé de la décision.

Dans les autres cas, ce relevé est adressé au comptable de la direction générale des finances publiques en même temps qu’il est procédé à la signification ou à la notification de la décision.

Ces relevés sont adressés sous un bordereau d’envoi simplifié, dont le modèle est arrêté conjointement par le garde des sceaux, ministre de la justice, et par le ministre des finances.

L’envoi de ces relevés dispense d’adresser ultérieurement un extrait de la décision lorsque celle-ci est devenue exécutoire.
