The provisions of Council Regulation (EC) No 343/2003 of 18 February 2003 establishing the criteria and mechanisms for determining the Member State responsible for examining an asylum application lodged in one of the Member States by a third-country national or commitments identical to those provided for in that Regulation concluded with other States shall apply to asylum applications lodged by a person enjoying temporary protection.
The Member State of the European Union responsible for examining an asylum application submitted by a person enjoying temporary protection is the State which has accepted the transfer of the said person to its territory pursuant to the provisions of Articles R. 581-10, R. 581-11, R. 581-13 or R. 581-14.
Where an asylum application has been registered by the French Office for the Protection of Refugees and Stateless Persons prior to the transfer of the foreign national benefiting from temporary protection to another Member State of the European Union, the transfer of the person concerned to the territory of this other Member State leads to the Office being relinquished.
