Article R581-9 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When a foreign national is granted temporary protection in France, his/her spouse, minor children or, where applicable, his/her spouse’s minor children, where they are not yet present on the territory of a Member State of the European Union, benefit from a reunification measure on French territory on condition that they require protection and subject to reception capacity. The decision is taken by the departmental prefect and, in Paris, by the police prefect.

Lorsqu’un étranger bénéficie de la protection temporaire en France, son conjoint, ses enfants mineurs ou, le cas échéant, les enfants mineurs de son conjoint bénéficient, lorsqu’ils ne sont pas encore présents sur le territoire d’un Etat membre de l’Union européenne, d’une mesure de regroupement sur le territoire français à la condition qu’ils nécessitent une protection et sous réserve des capacités d’accueil. La décision est prise par le préfet de département et, à Paris, par le préfet de police.
