Article R611-26-2 of the French Commercial code

The request referred to in the third sentence of the first paragraph of Article L. 611-7 is accompanied by the following:

1° The request for notice sent to the participating creditors, which reproduces the provisions of the first paragraph of article L. 611-7 and I of Article L. 642-2 and on which each creditor has mentioned its opinion or, failing this, a document justifying the request for an opinion;

2° The conciliator’s agreement to take on the assignment;

3° The debtor’s agreement to the terms of remuneration due for this assignment.

The order by which the President grants the request and determines or modifies the conciliator’s mission shall set, in accordance with the provisions of Section V of this Chapter, the terms of remuneration for this additional mission. The Registrar shall notify the claimant and the conciliator of the decision. The provisions of the second paragraph of Article R. 611-25 as well as those of articles R. 611-47 and R. 611-50 are applicable to it.

Article R611-26-2

La demande mentionnée à la troisième phrase du premier alinéa de l’article L. 611-7 est accompagnée des éléments suivants :

1° La demande d’avis adressée aux créanciers participants, qui reproduit les dispositions du premier alinéa de l’article L. 611-7 et du I de l’article L. 642-2 et sur laquelle chaque créancier a mentionné son avis ou, à défaut, un document justificatif de la demande d’avis ;

2° L’accord du conciliateur pour prendre en charge la mission ;

3° L’accord du débiteur sur les conditions de rémunération dues au titre de cette mission.

L’ordonnance par laquelle le président fait droit à la demande et détermine ou modifie la mission du conciliateur fixe, conformément aux dispositions de la section V du présent chapitre, les conditions de rémunération de cette mission complémentaire. Elle est notifiée par le greffier au requérant et au conciliateur. Les dispositions du deuxième alinéa de l’article R. 611-25 ainsi que celles des articles R. 611-47 et R. 611-50 lui sont applicables.
