Article R6111-40-2 of the French Public Health Code

When the hospitalisation of a prisoner is required under the conditions referred to in article R. 6111-39, the head of the penitentiary establishment shall notify the director of the health establishment as soon as possible so that he can take all necessary steps to ensure that the prisoner is accommodated in suitable premises, so that he can be cared for under the conditions provided for below without causing any inconvenience to the hospital service or to other patients.

The head of the prison must also provide all useful information to the departmental prefect or, in the department of Bouches-du-Rhône, to the Bouches-du-Rhône police prefect in order to enable him to prescribe the escort and custody of the hospitalised prisoner by the police or gendarmerie services and, in general, to take the appropriate measures to avoid any incident taking into account the personality of the subject.

Lorsque l’hospitalisation d’un détenu s’impose dans les conditions visées à l’article R. 6111-39, le chef de l’établissement pénitentiaire avise dans les meilleurs délais le directeur de l’établissement de santé afin qu’il prenne toutes dispositions pour que l’intéressé soit accueilli dans des locaux adaptés, de manière à ce que la garde de celui-ci puisse être assurée dans les conditions prévues ci-dessous sans entraîner de gêne pour l’exécution du service hospitalier ou pour les autres malades.

Le chef de l’établissement pénitentiaire doit donner également tous renseignements utiles au préfet de département ou, dans le département des Bouches-du-Rhône, au préfet de police des Bouches-du-Rhône pour la mettre en mesure de prescrire l’escorte et la garde du détenu hospitalisé par les services de police ou de gendarmerie et, d’une façon générale, pour arrêter les mesures propres à éviter tout incident compte tenu de la personnalité du sujet.
