Article R6111-40-5 of the French Public Health Code

Prisoners suffering from the mental disorders referred to in article L. 3214-3 may not be kept in a prison.

On the basis of a detailed medical certificate and in accordance with the legislation in force, it is the responsibility of the prefectoral authority to have them involuntarily hospitalised as soon as possible in a health establishment authorised under article L. 3214-1.

The rule set out in the second paragraph of article R. 6111-40-2 concerning their guarding by police or gendarmerie personnel during hospitalisation is not applied to them.

Les détenus atteints des troubles mentaux visés à l’article L. 3214-3 ne peuvent être maintenus dans un établissement pénitentiaire.


Au vu d’un certificat médical circonstancié et conformément à la législation en vigueur, il appartient à l’autorité préfectorale de faire procéder, dans les meilleurs délais, à leur hospitalisation d’office dans un établissement de santé habilité au titre de l’article L. 3214-1.


Il n’est pas fait application, à leur égard, de la règle posée au second alinéa de l’article R. 6111-40-2 concernant leur garde par un personnel de police ou de gendarmerie pendant leur hospitalisation.
