Article R612-11 of the French Intellectual Property Code

The application for grant shall be supplemented, where applicable, by indications relating to:

1° The reduction in the rate of royalties granted to the applicant or requested by him;

2° Earlier registrations whose elements may have been taken over;

3° Priorities claimed;

4° The presentation of the invention at an official or officially recognised exhibition.

In the event of non-compliance with the provisions of 3° of Article R. 612-10, the applicant shall be invited to regularise his application within a period of sixteen months from the filing date or the earliest date from which the patent application benefits or, if priority has been claimed, the priority date.

La requête en délivrance est complétée, le cas échéant, par les indications relatives :


1° A la réduction du taux des redevances accordée au demandeur ou requise par lui ;


2° Aux dépôts antérieurs dont les éléments ont été éventuellement repris ;


3° Aux priorités revendiquées ;


4° A la présentation de l’invention dans une exposition officielle ou officiellement reconnue.


En cas de non-respect des dispositions prévues au 3° de l’article R. 612-10, invitation est notifiée au demandeur d’avoir à régulariser sa demande dans un délai de seize mois à compter de la date de dépôt ou de la date la plus ancienne dont bénéficie la demande de brevet ou, si une priorité a été revendiquée, de la date de priorité.
