Article R612-41 of the French Intellectual Property Code

Excluded from communication to the public are:

– draft decisions and opinions, as well as documents not communicated to the applicant used in the preparation of these decisions and opinions;

– documents relating to the designation of the inventor if he has waived designation as such under the conditions provided for in Article R. 611-16;

– documents containing personal data or relating to business secrecy;

– any other document excluded from consultation by decision of the Director General of the Institut national de la propriété industrielle as not being of interest for the information of third parties.

Article R612-41

Sont exclus de la communication au public :

– les projets de décision et d’avis, ainsi que les pièces non communiquées au demandeur servant à la préparation de ces décisions et avis ;

– les pièces relatives à la désignation de l’inventeur s’il a renoncé à être désigné en tant que tel dans les conditions prévues à l’article R. 611-16 ;

– les pièces comportant des données à caractère personnel ou relatives au secret des affaires ;

– toute autre pièce écartée de la consultation par décision du directeur général de l’Institut national de la propriété industrielle comme ne présentant pas d’intérêt pour l’information des tiers.
