Article R612-52 of the French Monetary and Financial Code

When the Commission decides to impose a penalty payment in accordance with the provisions of articles L. 612-39 to L. 612-42, it does so in the same decision. The daily amount may not exceed fifteen thousand euros.

In the event of total or partial non-fulfilment or late fulfilment, the Commission shall liquidate the periodic penalty payment that it had ordered. The amount of the penalty payment is calculated taking into account the behaviour of the person concerned and the difficulties encountered in complying. The astreinte is not liquidated or is only liquidated in part if it is established that the non-performance or the delay in performance is due, in whole or in part, to an unrelated cause.

Lorsque la commission décide d’assortir sa décision de sanction d’une astreinte, en application des dispositions des articles L. 612-39 à L. 612-42, elle le fait par la même décision. Son montant journalier ne peut excéder quinze mille euros.

En cas d’inexécution totale ou partielle ou d’exécution tardive, la commission procède à la liquidation de l’astreinte qu’elle avait prononcée. Le montant de l’astreinte est liquidé en tenant compte du comportement de la personne concernée et des difficultés d’exécution qu’elle a rencontrées. L’astreinte n’est pas liquidée ou n’est liquidée qu’en partie s’il est établi que l’inexécution ou le retard dans l’exécution provient, en tout ou partie, d’une cause étrangère.
