The benefit of the filing date of the patent application is acquired on the date of submission of at least one copy of the documents listed in Article L. 612-2, drawn up in the French language, subject to the provisions of Article R. 612-21.
Where one of the documents mentioned in the previous paragraph is missing, the applicant shall be invited to complete the patent application within a period of two months.
If the applicant complies with this invitation, the filing date is that on which the application was completed; this date is notified to the applicant. Otherwise, the application is declared inadmissible; the documents submitted are returned to the applicant and any fees paid are refunded.
A reference to a previously filed application made in accordance with c of Article L. 612-2 must indicate the filing date, the number of that application and the Office with which it was filed. Such a reference must specify that it replaces the description and, where applicable, the drawings.
If the application contains a reference in accordance with the preceding paragraph, a copy of the previously filed application, accompanied, where applicable, by its translation into French must be filed within two months of the filing of the application.
