Article R6123-34 of the French Labour Code

France Compétences draws up and updates correspondence tables associating each professional branch and each company’s establishments with the skills operator to which they belong, with regard to:

1° The professional and inter-professional scope of intervention of the skills operator defined in the approval order referred to in Article R. 6332-1 and, where applicable, its scope of intervention in overseas collectivities;

2° The main activity of the establishments in question.

To this end, France Compétences relies on the information provided in employers’ nominative social declarations, checking that it is consistent with the criteria defined in 1° and 2°. It may also send requests for information to the company or operators concerned and refer the matter to the Minister for Vocational Training for an opinion.

France compétences établit et actualise des tables de correspondance associant à chaque branche professionnelle et aux établissements de chaque entreprise l’opérateur de compétence dont ils relèvent, au regard :

1° Du champ d’intervention professionnel et interprofessionnel de l’opérateur de compétences défini dans l’arrêté d’agrément mentionné à l’article R. 6332-1 ainsi que, le cas échéant, de son champ d’intervention dans les collectivités d’outre-mer ;

2° De l’activité principale des établissements considérés.

A cette fin, France compétences s’appuie sur les informations communiquées dans les déclarations sociales nominatives des employeurs, en vérifiant leur cohérence avec les critères définis aux 1° et 2°. Elle peut également adresser des demandes d’information à l’entreprise ou aux opérateurs concernés et saisir, pour avis, le ministre chargé de la formation professionnelle.
